1. Acceptance of Terms

By accessing or using the website located at fontanaasphaltpaving.com or by requesting, scheduling, or receiving services from Fontana Asphalt Paving ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. These Terms apply to all visitors to our website and to all customers who enter into a service agreement with us, whether verbally, in writing, or by accepting an estimate.

2. Description of Services

Fontana Asphalt Paving provides asphalt paving, sealcoating, repair, resurfacing, parking lot maintenance, driveway paving, concrete curbing, grading, drainage, and related services to residential and commercial customers in Fontana, CA and surrounding communities. The specific scope of work for any project is defined in the written estimate or contract provided to the customer.

We reserve the right to decline any project or request at our discretion, including projects outside our service area or scope of expertise.

3. Estimates and Pricing

All estimates provided by Fontana Asphalt Paving are based on an on-site inspection of the project area and represent our best assessment of the work required at the time of the estimate. Estimates are not binding contracts until both parties agree in writing to the scope and price.

Final pricing may vary from an estimate if conditions change between the time of estimate and the start of work - for example, if additional damage is discovered during surface removal, if material costs change significantly, or if the project scope is modified at the customer's request.

We will notify you of any material changes to scope or price before proceeding. Verbal price discussions are for reference only. Written estimates are the authoritative document.

4. Scheduling and Cancellations

Scheduling is subject to crew availability, weather conditions, and material supply. We will provide you with a scheduled date and confirm by phone or email before the work begins.

We reserve the right to postpone scheduled work due to unsafe weather conditions, equipment issues, or circumstances outside our control. We will contact you as soon as practicable to reschedule.

If you need to cancel or postpone a scheduled job, please notify us at least 48 hours in advance. Cancellations made with less notice may be subject to a rescheduling fee to cover mobilization costs already incurred.

5. Customer Responsibilities

Prior to the start of any work, the customer is responsible for:

• Clearing the work area of vehicles, personal property, and obstructions.
• Notifying us of any underground utilities, irrigation lines, or other subsurface features that may be affected by the work.
• Obtaining any required HOA approvals before work is scheduled.
• Ensuring adequate access to the work area for our crew and equipment.

Failure to prepare the site as agreed may result in rescheduling or additional charges.

6. Payment Terms

Payment terms are specified in the written estimate or contract for each project. Unless otherwise agreed in writing:

• A deposit may be required before work begins, as stated in your written agreement.
• The remaining balance is due upon completion of the work, before our crew departs the job site.
• Accepted payment methods will be specified in your agreement.

Invoices not paid within the agreed timeframe may accrue a late fee as specified in your written agreement. We reserve the right to suspend or withhold services for accounts with outstanding balances.

7. Warranty and Workmanship

We stand behind the quality of our work. Any warranty on materials or workmanship will be specified in your written estimate or contract. Warranty coverage is subject to the following conditions:

• The warranty applies to defects in workmanship that arise under normal use and conditions.
• The warranty does not cover damage caused by subsurface movement, tree roots, ground settlement, vehicle abuse, chemical spills, or other conditions outside our control.
• Warranty claims must be submitted in writing to info@fontanaasphaltpaving.com within the warranty period specified in your agreement.

No other warranties, express or implied, are provided beyond what is stated in the written agreement for your project.

8. Warranty Disclaimers

The website and its content are provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Fontana Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of our website or services, even if we have been advised of the possibility of such damages. Our total liability to any customer for any claim related to services performed shall not exceed the amount paid by that customer for the specific work giving rise to the claim.

10. Dispute Resolution

If a dispute arises between you and Fontana Asphalt Paving relating to our services or these Terms, we ask that you first contact us directly to attempt a resolution. Most issues can be addressed quickly through direct communication.

If a dispute cannot be resolved informally, both parties agree to attempt mediation before pursuing litigation or arbitration. The mediator shall be mutually agreed upon by both parties.

11. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings arising from or relating to these Terms shall be brought in the appropriate courts located in California.

12. Website Use

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the site.
